DALLAS - The excessive court will allow a wrongful loss of life lawsuit to proceed in opposition to town of Dallas and four cops.

The household of a man who died in police custody in 2016 sued.

Tony Timpa called police for help as he had a drug and psychological health crisis.

Town fought towards releasing body camera video and whit it did come out it was obvious why. It confirmed the officers mocking the dying man.

One had his knee on Timpa’s back and neck for nearly 15 minutes and the medical expert mentioned that contributed to his demise.

Town of Dallas argued the officers are legally protected from lawsuits.

The Supreme Courtroom upheld a federal appeals courtroom’s ruling that may allow the case to proceed.

"The choice signifies that the case can proceed to trial and that there can be no more delays from any appellate court. Additionally, the choice means that the Fifth Circuit did it proper that their ruling relating to lethal force would be the legislation of the land at the least in Mississippi, Texas and Louisiana for as long as we know," stated Geoff Henley, an attorney for Timpa’s family.

Those are the states lined by the Fifth Circuit Court docket of Appeals ruling permitting the go well with to proceed.

Three years ago, the Dallas district attorney dropped criminal fees in opposition to three of the officers.
